Rhythm Engine™ Data Commitment & Privacy Policy

1. What This Is

This quiz is a short, self-scoring assessment hosted on our website that gives you a quick read on transformation risk or change readiness. Completing it does not create an account and is not linked to any employer’s Rhythm Engine deployment.

This notice explains what personal information we collect when you complete the quiz, why we collect it, where it is stored (including overseas), and what rights you have under the Australian Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

This Policy applies to all personal information collected through the quiz and any subsequent interaction with us in connection with it. By submitting the quiz, you acknowledge that you have read and understood this notice.

2. Who Is Responsible For Your Data

This quiz is operated by Truman Adler Pty Ltd (ACN: 697 065 142), (trading as RhythmEngine) – the licensed operator of this quiz, your primary point of contact for all privacy matters and the technology partner whose platform underpins data processing for this tool.

We are responsible how your personal information is handled under this notice. For any privacy query or request, contact us using the details in Section 10.

3. What We Collect

When you complete the quiz, we collect:

  • Your answers to the quiz questions.
  • Your name and email address, entered by you at the point of submission.

We do not ask for payment details, employer system access, identification documents, or any sensitive information as defined under the Privacy Act.

4. Unsolicited Information

In the event that we receive personal information about you that we have not actively sought to collect – for example, if a third party provides your details to us – we will assess whether that information is reasonably necessary for, or directly related to, our functions or activities.

Where it is not, we will destroy or permanently de-identify that information as soon as practicable, subject to any legal obligation to retain it. Where it is reasonably necessary, we will handle it in accordance with this notice and the Australian Privacy Act 1988 (Cth).

If at any time you supply us with personal information about another person, you must ensure you have that person’s consent to do so, and you agree to inform them of the existence of this notice and the manner in which their information may be used.

5. Why We Collect It

We collect your information for the following purposes:

  • To display your quiz result on screen immediately upon submission.
  • To follow up with you about Rhythm Engine products and services. By submitting the form, you acknowledge that we may contact you in regard to Rhythm Engine products and/or services. Important: We recommend you notify us should you wish to withdraw consent to follow-up contact. You can withdraw consent at any time – see Section 8.

6. Where Is Your Data Stored

  • Primary Storage – WordPress / Formidable Forms
    Your quiz submission is stored in the Formidable Forms database on our WordPress website. This website is hosted by Bluehost, whose servers are located in the United States of America.
  • Cross-Border Disclosure (APP 8): By submitting this quiz, you acknowledge that your personal information will be stored on servers located in the United States. We have taken reasonable steps to ensure Bluehost handles your data in a manner consistent with the Australian Privacy Principles. However, once your data is held overseas, it may be subject to the laws of that country, including access by law enforcement or government authorities under those laws.
  • Your data is not transmitted to any external AI service or third-party analytics processor in connection with this quiz.

7. Who Can See Your Data

Your response is visible only to authorised staff of Rhythm Engine, strictly for the purposes described in Section 5. Your data is not:

  • Shared with, or visible to, any client organisation or employer.
  • Sold or licensed to any third party.
  • Used for any purpose beyond those stated in this notice without your prior consent.

Where we disclose your personal information to third-party contractors or advisors to assist in delivering our services, we take reasonable steps to ensure those parties handle your information consistently with this notice and the Australian Privacy Principles. We do not authorise those parties to use or disclose your information for any purpose other than to perform services for us.

8. How Long We Keep It

We retain your personal information for as long as is necessary to fulfil the purposes for which it was collected, including to satisfy any applicable legal, regulatory, accounting, or reporting obligations.

To determine an appropriate retention period in any given case, we consider the nature and sensitivity of the information, the potential risk of harm from unauthorised use or disclosure, the purposes for which we hold the information, and whether those purposes can be achieved by other means.

When your personal information is no longer required, we will take reasonable steps to destroy or permanently de-identify it. If you request deletion before that point, we will action that request promptly – see Section 9.

9. Your Rights

Under the Australian Privacy Act 1988 and the Australian Privacy Principles, you have the right to:

  • Access: Request a copy of the personal information we hold about you (APP 12).
  • Correction: Ask us to correct any inaccurate or incomplete information (APP 13).
  • Deletion: Request that your quiz submission be deleted at any time.
  • Restrict processing: Ask us to limit how we use your information in certain circumstances.
  • Withdraw consent: Opt out of follow-up contact at any time, without providing a reason.
  • Complain: Lodge a complaint about how we have handled your personal information (see Section 10).

We reserve the right to verify your identity before acting on any access or correction request. We will respond to all requests within 30 days.

10. Complaints

If you believe we have not handled your personal information in accordance with the Australian Privacy Principles, you may:

  • Contact us directly in the first instance – we will investigate and respond within 30 days.
  • If you are not satisfied with our response, lodge a complaint with the Office of the Australian Information Commissioner (OAIC) at www.oaic.gov.au, by email at enquiries@oaic.gov.au, or by calling 1300 363 992.

11. Security

We use the following measures to protect information submitted through this quiz:

  • Our website is hosted on a platform that supports HTTPS encryption for data in transit. We rely on our hosting provider, Bluehost, to maintain this standard. We recommend you verify the padlock icon is present in your browser before submitting the quiz.
  • Access to quiz submission data within the WordPress/Formidable environment is restricted to authorised personnel only.

No online system is completely secure. We treat data security as an ongoing responsibility and will notify affected individuals and the Office of the Australian Information Commissioner (OAIC) in the event of an eligible data breach under the Notifiable Data Breaches (NDB) scheme, as required by Part IIIC of the Privacy Act.

12. Changes To This Notice

We may update this notice from time to time. The version number and effective date at the top of this document reflect the most recent revision. We will publish the current version at https://rhythmengine.io/privacy-policy/.

Material changes will be noted on the quiz page. We encourage you to review this notice before submitting the quiz. Unless otherwise stated, the most current version of this notice applies to all information we hold about you.
